Some thought they wouldn't. But they did. The FTC has approved a rule that would ban nearly all employee noncompete agreements nationwide. What does all this mean for employers and employees in tech, financial services, healthcare, and other industries that commonly use noncompetes? After a year of public comment and debate, the Federal Trade Commission has voted to ban virually all employee noncompete agreements nationwide. A result of the purported ban on noncompete agreements will be massive uncertainty for the employers who rely on them. That uncertainty is a feature, not a bug.

Non-compete lawyers have been known to whisper darkly about how their practices would be impacted if non-competes were ever to be outlawed. Now that the FTC is actually pushing for a nationwide ban, has doomsday arrived?

Will the FTC really ban non-compete agreements? Maybe, maybe not.
